How did they get these machines installed past voter security? It's obvious that somehow these machines got widespread throughout the United States, and it was done very very quietly.

1. What is the % U.S. votes done on DIEBOLD machines?

2. What is the % of U.S. votes done on electronic voting machines?

3. What is the % of U.S. votes counted on optical scanners?

4. Does Bev Harris of blackboxvoting.org know about this?

NOW...can we revisit the exit polls that said Kerry won the election by 5 million popular votes, MSM?

And they're goiNg to exploit it again.....someone has got to shut Diebold and ES&S down and force them to turn over their source code!!!!

Kkkarl Rove had an open sales system a deal with the devil at Diebold and manipulated totals with the help of some cronies.....Didn't blackwell also have the same open-door Diebold tabulator in the office?

If they had to adjust all the triad machines....and Diebold was running the main server that would explain the recount anomolies that fixed the count. They simply had to "adjust" to match the Diebold program and then deny everyone access to the logs.

Someone in Ohio/Nebraska needs to file open lawsuit to these bastards to release those source code logs!!!! This is no less than treason!

Hilarious. I'm an IT guy and receive these USCert bulletins...I remember seeing this particular weekly summary last year. Passed it on to my boss with the Diebold entry highlighted and we wondered about the shitstorm that was sure to follow. It didn't make news then, and it won't make news now. Thanks for your hardword on bradblog...I wish we could get these 'commercially-made-busy' people of america to wake up and remove themselves from the boob tube for 15 minutes to see what is happening.

Bingo! Great work Brad. I've always felt that sooner or later a "Dieb Throat" would surface. Will your source testify at trial, Brad? And are they prepared to make these claims ("Everyone knew...") to the general public?

It would be great if your source could round up some employees at Diebold with evidence that proved what top management knew, and even better if someone knew of any collusion with "elected" officials. Might be interesting to subpoena Diebold's phone records...

What's been uncovered here is what Bev Harris has been saying for months. What's important about this story is the fact that its confirmation that Diebold knew how easy it was to manipulate their software & hardware, and purposefully had no intention of "fixing" the glitch. It's obvious to me that it was left there for a very clear purpose.

Now we just need a whistleblower from the Bush/Cheney camp to come forward to connect the dots.

Keep up the great work Brad. Were getting closer and closer and sooner or later somethings going to tip the scales thatll rid us of these criminals once and for all.

Just look at all the repercussions this illegal vote has had -

- let's start with the Supreme Court and the future of the Court for the next few decades!

- The lives lost due to Katrina and the bungled federal response from Bush cronies!

- The entire war in Iraq, if we go back to the same problem in 2000! (And maybe even 9/11, depending upon the way you feel about Bush & Co. complicity in that!)

- How many in the Senate and House fell due to the same modem "fixes"? There's been some talk of these as well. And now they're targeting Hillary!!!

The stolen presidency, the entire majority in both houses, the Supreme Court - we have lost control of our government "of the people, by the people and for the people"!

How can this be reversed - what legal ramifications are there, and how do we get our government back?

I don't know... After the Repubs shut down the resolution of inquiry in the House yesterday, it seems there's nothing short of resistance or revolution left as feasible solutions.

With complete control of the government and the media it's evry man for him/herself. Stay out of potential disaster areas and large cities, use every means available to save $$$ (keep a good horde of cash), and limit your tax liability.

Stop driving when gas gets over $2.50/gallon. Complain to your bosses and their bosses.

Pay no attention to Hillary and Joe Biden. They're just grandstanders. Keep fighting but keep your own counsel. Refuse to vote in '06 and protest loudly. Let the govt. and media know that your contempt for the system is absolute.

I don't think they're saying the primary problem is with the Diebold software. It's that it (Diebold's GEMS) uses the MicroSoft Access database system and it's that database system which is open to intruders.

Is there even a security system with Access? Is it as simple as dialing up via modem and accessing it as easily as one would the same database on your own home pc?

Trying to get MS to fix their database system is probably like asking them to fix their Internet browser or operating systems. It ain't gonna happen.

I wonder if there is any audit trail kept on modem accesses or other database accesses which could still be in existence. Is there any indication of what changes might've occurred and when and by whom? Wouldn't it be wonderful if such an audit trail suddenly appeared?

This story should be on the front page of every newspaper in America tomorrow morning in very large type. How much would you bet that it won't?

The reason he doesn't go to CNN is the same reason Clinton Curtis won't.

I must respond to #23, Texas Lady. My comment regarding Brad's "vacation" was a repeat of what Brad himself said the other day. The same way that we keep referencing the "6 or 7" bradblog readers, I was referring to Brad's "vacation" as he himself called it, tongue in cheek of course!!! I in no way meant anything negative towards Brad in refering to the comment - I thought it was terrific that while he was away Brad was working so much harder than most of us do every day of the week and with such great results. His work at Camp Casey was admirable and gave us all a great sense of what was going on there while helping to further her continuing quest that we'll be seeing in the days and weeks ahead. Did anyone go to the US Cert entry for the Diebold security report? Hmm? See that column labeled source? The source of the report is BlackBoxVoting.org. Brad, I have to say that this part of your argument, at least to me, is meaningless in that it is self referential. I don't see anywhere that an independent certification of the reported software deficiency has occurred. I can't trust it if its only proof is itself. But the Dieb-Throat stuff is good.

Right after the November 2003 elections I saw some stories on voting results compared to exit polls. Exit polls were everywhere reliable, except for three(?) big states where the actual outcome of the elections differed approximately 5% from the exit polls and this was every time favorable for Bush. In all of the three states voting machines without paper trail from Diebold were used.

There hasn't been any follow up on this story.

Now, I don't know if it wasn't a hoax, but it makes one suspicious. Might the back door have been used already?

I believe that we have to encourage those on the inside, in the face of a "culture of fear", as Dieb-throat has done, to leak to the press anything they believe might expose BushCo chicanery and manipulations.

How can BushCo insiders be enticed into leaking more and more information about BushCo manipulations, threats, deceptions...by publicicizing the degree of criminal culpability they may face for complicity in treason?!?! I know that sounds like a dream, to actually hold BushCo accountable, but if they have committed crimes, as we know they have, and there is a chance that they will be held accountable, perhaps those accomplices might recognize the benefit of getting out early, to minimize their own liability??

I think T-shirts should flood the nation that say something along the lines of "A BushCo Whistleblower is the ultimate PATRIOT, and this ain't no ACT!!"

With this revelation, plus the analysis of the election by statisticians looking at exit polls, combined with the "What Went Wrong in Ohio" report by Rep. Conyers, it seems that we folks who have been highly skeptical of the last election results have the makings for a great case of election fraud. Some subpoenas and legal discovery of documents belonging to Diebold and other election machine companies could probably expose the whole dirty scheme and most of its perpetrators --- if only Congress and other already tainted government officials would follow up. There's the rub. Just how widespread is the government corruption that would have an interest in covering all this up? We shall see.

I couldn't agree more. It'd be great to figure out a way to bring out potential whistleblowers. But you can be sure that coming out is a risky business with these criminals in power. I'm pretty sure that there are folks who read these blogs who themselves have information that could be used to connect the dots on some of Bush & Co's criminal activities, but look what happened to Ray Lemme! We have to provide a way of keeping these Patriots safe, while encouraging them to share what they know. Perhaps we could start a "Safe Haven Fund" or something to raise donations to be used towards protecting these individuals.

We've already already known much of this, thanks to Bev Harris and Howard Dean, who broke into the Diebold system on MSNBC last OCTOBER, the month before the election.

All this does is merely verify it. I would like to think that Congress can put the screws to these crooked cocksuckers before the mid-term elections next year but the majority Republicans, obviously, will just throw up red tape like they always do. After all, how can you expect Republicans to benefit from prosecuting or at least persecuting the very same company that illegally put them in power, in the first place (you listening, "Senator" Chambliss?)?

Brad provides zero evidence that this whistleblower is for real. For all we know, he could have made him up.

I desperately want this story to be true. I desperately want a whistleblower to credibly blow this whole e-voting thing wide open and expose it for the risk that it is. Even if someone hasn't already manipulated an election, which is improbable, the ease at which it can be done almost ensures that it will be done, given the monetary and ideological stakes involved.

But posts like this, with absolutely no confirming evidence, are helping the e-voting industry. They are like crying wolf until no one listens anymore. And anything that helps Deibold et al. is an enemy to democracy. This post, with its unsubstantiated whistleblower is doing the business of Diebold and co. It is Brad that should be on Diebold's payroll.

Now, if "DIEB-THROAT" turns out to be the smoking gun that shakes the halls of power, I will not have to retract. Because I am not saying that DIEB-THROAT isn't for real. I am saying that Brad has provided no confirming evidence that he's for real. And if Brad is for real, and wants to resemble good investigative journalism, he should abstain from posting unverifialbe claims. No matter how sincere.

The biggest challenge we face in getting these machines out of our electoral process is CREDIBLY showing that they are a threat to democracy. This means not meeting the evidentiary and journalistic standards of a major newspaper like the Times. It means exceeding those standards.

Remember, this isn't about the truth, it is about PROVING the truth. Brad should be working his source quietly, getting him to provide documentation, source code etc. He should take this to a credible journalist or two who can independently verify the source and the source's claims. Greg Palast would be good. He shyould have waited until this story is rock solid before even posting it. And he should do all of these things before posting again.

Again THESE UNSUBSTANTIATED CLAIMS ARE HURTING THE CAUSE. Wanyne Madsen and Bev Harris, have done far more damage than good by making wild claims that they can never prove. Now, as a result, a huge chunk of the blogosphere doesn't even listen anymore. And as a result, Deibold benefits. This makes them, inadvertantly or not, the enemy.

Don't be the enemy.

Diebold didn't put elections "at risk." On the contrary, the whole idea was to eliminate the risk, i.e., that John Kerry might win Ohio and with it the election. They sought to ELIMINATE that risk by allowing crooks to access their tabluators.

This dispenses once and for all with the childish notion (still adhered to by the mainstream media) that a "massive conspiracy" was necessary to rig the election. I think the allegation *might be* that it's not the Diebold or other tabulators which are flawed, so much as the breakability of MS-Access. If that's true then it doesn't take any bad source code from Diebold to reveal what's going on. One only need hack the database to show, as Bev Harris did, that the systems aren't secure. Remember how the results were posted at one time in the evening, but that later some results changed? That could reflect hacking.

What is the AutoMark system? That's a new name I haven't heard before.

I saw Rep. Curt Weldon this evening on C-SPAN, talking about Able Danger. Is it possible the Dems want to get the Repubs on this 9/11 stuff, but the Dems have this bit of 'history' which the Repubs threaten to reveal --- a bit of Mutually Assured Destruction insurance? Is there some similar gotcha in the election system which hinders Dems from seeking to reveal how the Repubs 'won'? What could the Dems have done which they wouldn't want revealed now?

Which vote databases were open to access via modem on election night? How would one go about finding that out? Even worse, how could one find out if a 'private line' had been established (a local network) by some Repub evil-doers and the tabulator machines, so that a modem link to the world wasn't even necessary? What I mean is that it might've been possible the votes were changed by someone with more direct access to the machine(s), either direct hands-on or local area network connections.

The one instance I read of, where an elections official turns on an e-voting machine and on the screen it says "Are we having fun yet?" seems ever more scary. There are more than a few people with the skills to hack the e-voting software and to them MS-Access would probably look like swiss cheese with some very large holes.

Even the selective recounting with paper trails doesn't seem perfect. Remember how they faked it in Ohio? We need also to make exit poll information valid indicators which would make an automatic investigation required when there are discrepancies.

While not an investigative organization they did the best they could in their defense considering they weren't allowed at ground zero and they weren't allowed to where the Shrub missile crashed into the Pentagon until sometime in October.

Great story Brad. I know that I work at a large place of about 800 people, and 75-80% of everyone I know voted against Bush. But then, those of us in Florida and Ohio knew better. How many counties in our states had more votes, than registered voters? Shouldn't

I hope that more true patriots such a Dieb-Throat will step forward. These machines are being rushed into many more jurisdictions daily, paid for by the American taxpayer.

There is very strong statistical proof that the vote was manipulated. The exit polls WERE NOT WRONG. Unfortunately this isn't enough. We probably won't learn the truth for another 50 years, IF EVER.

So, if as Brad reports, this "backdoor" vulnerability was first reported by blackboxvoting.org, you should probably give them more credit and refer to the attempts they have already made to document, investigate and publicize the story. What is new is the acknowledgement and concern of a Diebold insider and the work done by Brad to interview company and local elections officials who should have known and responded to the original warning.

A very troubling development has arisen in the collection of bodies in New Orleans.The company brought in by FEMA and Homeland Security to process the bodies is a company called Kenyon International. Kenyon International is owned by SCI, a major Bush family contributor.

During George W Bush's tenure as Gevernor of Texas, SCI was involved in "FUNERALGATE" -the biggest corpse mishandling scandal in American history, wherein thousands of corpses were allegedly disenterred and haphazardly dumped to make way for new gravesites. Family members of the deceased were shocked to learn that their grandmothers, fathers, sisters etc. were not in burial plots that had been bought for tens of thousands of dollars each, but dumped en masse and left to rot in swamps and mass burial pits. You may remember this...I do, it was on every major news network at the time.

What is not so publicly known, is that at the time, there were rather serious claims made about the complicity and/or direct involvement of the then Governor George Bush and his chief of Staff and future FEMA director Joe Allbaugh in a coverup of the allegations (Yes, the same Joe Allbaugh that brought his college roomate Joe "Drownie" Brown into FEMA, and the same Joe Allbaugh who's consulting company has just scored muti-million dollar no-bid Federal contract to assist in the "cleanup" in New Orleans). There is an ongoing debate regarding the veracity and/or details of the claims involving the then Governor Bush, nevertheless, the appearences aren't kosher. At the end of this article, you'll find links to several news stories detailing some of the allegations and details of the scandal.

Whatever his involvement, George W Bush is fully aware of the matter, as he and Joe Allbaugh were deposed in a whistleblower lawsuit concerning it. SCI ulimately payed out over 100 million dollars to settle claims of wrongdoing. The question the American people should be asking is, why, when there were numerous Doctors and Coroners from around the country who volunteered to process the bodies for free, would the Administration give a no bid contract TO A COMPANY THAT HAS A HISTORY OF "MISHANDLING" BODIES!!!!!!!

Compounding the issue, are the following very troubling and suspicious actions on the part of the Federal Government:

1. The Federal Government's attempt to quash the First Amendment by refusing to grant access to reporters during the collection of bodies even after being ordered to do so by a Federal Judge ruling on a lawsuit brought by CNN;

2. Reports by very reputable reporters such as MSNBC's Brian Williams of law enforecement officials pointing guns at the media on numerous occasions in a blatant attempt to intimidate them AFTER the CNN ruling;

3.The presence of armed mercenaries in New Orleans such as BLACKWATER INTERNATIONAL, who has admittedly recruited war criminals from among Pinochet's secret police and South Africa's apartheid era military officers. When pressed on the issue, Homeland Security denied their presence in New Orleans, while BLACKWATER's website and numerous reports from in the field of the mercenaries being used for "Search and Rescue" teams and "Security" (as readers may remember, these are some of the same types that provided "security' at Abu Grhaib), say otherwise;

4. Reports from among Ham radio operators that emergency radio signals are being jammed with very sophisticated technology form somewhere in the Gulf of Mexico, as well as numerous reports from local municipalities, most notably Jefferson Parish in a report which was publicised on national TV that FEMA was cutting phone lines and emergency communications equipment in NEW ORLEANS;

5. Numerous inconsistencies, documented live on National Television, between the Administration's version of what went on on the ground in the Gulf Coast, and what actually happened.

One might ask one's-self, is the same Administration which seemingly lied about Iraq, seemingly lied about the Valerie Plame/Karl Rove scandal, seemingly covered up the Abu Ghraib Scandal, and has already been caught in numerous lies about the Federal response to hurricane Katrina capable of covering it's tracks in the worst loss of life on US soil due to the Federal Governments negligence in US history by manipulating the numders of dead? Sure seems that way to a lot of folks.

One thing is certain: President Bush has full knowledge of the allegations made against SCI, the parent company of Kenyon International, and against Joe Allbaugh. The American People and History deserve a better company to faithfully and honestly collect the dead on the sacred dying ground of New Orleans. The American people deserve better than to have a company that employs war criminals patrolling the streets of an American city. This is not Columbia, this is not Iraq, and this is not Chile or South Africa. This is the United States fo America, and regardless of whether or not the government is trying to hide bodies, which is up for debate, the presence of companies such as BLACKWATER and SCI taking part in any way in "recovery efforts" on American soil is sickening and should be shock any American who values Freedom and openness in our Government.

Update: Since this post was first written, the office of the Governor of Louisiana has taken over the contract with Kenyon International. This action was taken due to Kenyon's threatening to back out of efforts due to foot dragging by FEMA. To be fair, Governor Blanco is most likely not privy to SCI and Kenyon International's seedy past.

Maybe somebody oughta give her a call and tell her.

In Canada, we have a revolutionary near fool-proof election result process, the US should consider adopting.

We physically put down an X beside the name of the candidate with a pen on paper. It is placed in a ballot box. Later the paper votes are counted by temporarlily hired citizens, with representatives from all the parties present.

This is done with the exact same standards all across the country. We get our results all counted by the early evening of voting day.

Spoiled ballots are easy to recognise, and if there is a close result in any riding, recount is easily done.

Of course I am being a little cheeky. But it makes you wonder why this push for machines, when people do a better, cheaper, and more efficient job of it.

If it ain't broke, why fix it? Hmmm, why indeed.

As a sotware professional for many years, and having programming machines like electronic voting machines, I know that it is a simple matter to plant code in the overall software system that activates on a certain date/time and/or event, then does its dirty work, then erases itself. Also, to use machines for voting and not have these machine independently and rigorously testing by independently testing labs, then put under lock and key until voting day should be illegal; certainly it is diabolical to resist testing your hardware/software system - it indicates you are up to no good. Florida and Ohio voting was a fraud - Kerry won, but the machines were rigged to make Bush win. Easy to do without validation testing.

There is not much new here.

It was always known that once you gain access to the machine GEMS is running on (you have to log into it, remotely via modem/net or locally, using a valid Windows NT user account with high enough priviledge; note the CERT advisory speaks of "Authenticted User") then you can access/change the GEMS database (based on MS ACCESS) directly using a hardcoded user/password combination (this is the "backdoor").

US-CERT doesn't validate or check the reports they get (they don't have the resources, staff or all the software/hardware), they just repost them.

So, the vulnerability is there (I followed the audit when it happened), but you have to have a valid login to the box and ONLY THEN (and if it's connected to the outside at all) you can get to the DB.

The Key difference about this story... is the timing.

Finally, some of the MSM has started to criticize the president. His numbers are down. His financial backers are starting to get nervous. And people are suddenly feeling a little bit skeptical about the drone of right wing talking points... they have been "roverwhelmed" by the same tired tactics that ring really hollow after the Katrina disaster.

Run with this story. Tell people about it. If nothing else, the US-CERT alert is a significant lead that merits the attention of the public. It requires real investigation... not by the government... but by independent institutions... blogs, traditional media, and grassroots political groups.

We were particularly disturbed by a prescient remark which stated that it would be incredibly easy for a well-placed individual in one of these companies making these machines to type in a few lines of code to pre-determine the outcome of the election and then delete itself later on.

You don't need the source code. The systems are written in Access on a modified WinCE platform.

There is no protection against manipulating the data any way you want. The code to do so can be written from scratch in Notepad (or even just from the command prompt) in a minute or two, using nothing more than VBScript, and just manipulating the JET Engine with ADO commands. It's not even real programming (heck, I write scripts like that every day, just to tabulate stuff I gather off our Intranet with batch files), and all of it is available on any machine that runs Diebold systems.

BTW, another thought; Diebold reportedly uses a hack of Wine to allow it to run on WinCE. WineHQ states that Wine is distributed with Lesser GPL, which, I believe, requires derivative works to be GPLed, too (or at least for free). I'm not a lawyer, so I don't know how to play that out . . .

Sorry but you don't get the tech of what's being stated. The Microsoft Access Data base has a real possibility of being altered, remotely.

That means that the program could do its thing just fine, and then LATER someone could just go into the stored count (at any time) and change the numbers. They could change a count to, say, a thousand extra. Then from that point on, even if voting continues, it is rigged. Or they could do it before the voting even starts or after the voting stops but before the official talley. Or check numbers and alter several times during voting.

It isn't the software they are talking about it is the Microsoft Access Data Base wherein the NUMBERS are stored.

Your bud at Diebold, your Dieb-throat, needs to do more than just chat you (or anyone else) up with stories of corruption, incompetence, or recklessness. I suggest he/she acquire a voice-activated tape recorder, or if he/she can afford it, a solid state version of same. S/he needs to go on record to a proper authority (perhaps a Congressman like Waxman or a Senator like Schumer) and seek their protection. S/he needs to try to get others in the evil society that is Diebold to provide substantiation in some way, shape, or form. Sneak out the the source code and hand it over on the sly to a Waxman or Schumer so that they can secretly have it analyzed, the claim verified, and then pounce all over Diebold after the goods are got. This person has to be prepared to put ethics and their country before their job at Diebold. If they are worth their salt they can get a job at a less corrupt place anyway - and they would be a hero in demand with TV and publishers if they actually came forward. People LIKE heros and courage.

As for you Kira, since you didn't read all your links before you posted them about PROMIS, I'll cut you slack on the 9/11 connection link. It is one of those discredited and nasty rumours that Israel was behind the 9/11 attack (via Mossad). Israel has its problems and lapses wrt their treatment of Palestinians, etc, but the crap about them being behind 9/11 is just more of the same old, tired anti-semitism. Electronic voting results are by their nature unverifiable and the reason is not technical but theoretical.

Votes must be anonymous, so nobody can verify if each of them is what its (unknown) voter actualy casted. Thus the only way to have certainity about electoral result is to collect votes using secure and verifiable procedures.

Paper elections held under proper public monitoring can guarantee fair and square elections. This is possible because humans can verify operations dealing with ballot papers which are visible and tangible objects. What's wrong with ballot paper?

Computer procedures are not verifiable by humans since we are not equipped for verifying operations which occur in the microscopic scale within nanosecond timeframes. Thus, for people who didn't program them, computers act just like black boxes and their operations can truly be verified only by knowing the input and comparing the expected output with the actual output. Unfortunatly, because of vote secrecy, elections have no known input nor any expected output with which to compare electoral results, thus electronic electoral results can't be verified by humans!

Hence electronic voting is not a simple technical evolution of classic paper voting

Electronic electoral result cannot be verified by humans and the people need to have an absolute faith in the accuracy, honesty and security of the whole electoral apparatus (people, software, hardware and networks).

Requiring reliance on such faith is clearly not compatible with Democracy.

E-voting's limitations are theoretical and thus cannot be overcome: electronic results are unverifiable whichever technical solution may be used to implement elections.

Our efforts are only effective if they are integrity based. Alleging that we should attempt to hack into a system just to prove it is hackable is not constructive IMHO.

We need to keep shining the light on this company and its officers. If we keep the pressure on for a congressional investigation the public will eventually come to realize there is something to this story and their curiosity will be piqued.

If I discovered , at a later date, that something I had given to someone in good faith (my vote for instance) was used in a base and senslesss act of aggression, (the war on iraq, outing plame, to many others to mention) that act of betrayal would become the catalyst of their undoing.

We need to focus on removing corruption. I know the frustration of watching these criminals get away with murder and mayhem sometime inspires thoughts of " Lets string 'em up!' But quite honestly, unless we can re-establish the

standards of integrity, and have them apply to all americans whether they are in political office or sequestered in detainee camps, then our position as free americans may become merely a footnote in history.

Keep your eyes on 2006. Get involved at your local level. Continue to e mail your elected officials

If even ONE DRE is used at a polling place (e.g. for disabled voters) it can be used to manipulate the entire election. That's right, the entire election--not just the votes from that machine. And "adjustments" to just one or two votes from each polling place can be enough to swing an entire election.

Ditto for if a central counting computer is used to combine the votes from various polling places (as is the case if any DREs are used)--all it takes is one to be able to control the whole election.

Giving voters an option of voting on paper would not prevent someone from manipulating an election. ALL the votes need to be on paper, and they must ALL be counted by hand in every election.

We need, no, must have leaders of great skill and intelligence to facilitate this transition from an Oil based energy dependence to what ever we can contrive to replace it.

It is sad reading the partisan (Democrat versus Republican) spin on the insecurity of electronic voting equipment.

Yes, it appears to be the case that, if insecurities in the current equipment were exploited, they were exploited more often and more effectively by Republicans by Democrats. But that's a temporary advantage.

Software insecurity owes no duty of loyalty to any party or any politician. The group in power, at any level of government, has significant power to disburse funds and to change laws and regulations in ways that benefit or harm other companies or individuals. Those individuals in turn have a strong vested interest in the outcomes of our elections.

Whether the group you mistrust most is Haliburton, Al Qaeda, the government of the Democratic Peoples Republic of Korea, the government of the Islamic Republic of Iran, the drug dealers in South America, the triads, or the Bill Clinton Fan Club, if the group has enough money, voting equipment insecurities give them an opportunity to rig our elections for their benefit.

Voting equipment insecurity poses deep risks to our democracy and to the power and independence of government officials, be they Republican or Democrat.

Spinning the issues of insecurity as partisan political makes it less likely that they will be taken seriously and more likely that they will go uncorrected.

The United States Election Assistance Commission is accepting comments on its Proposed Voluntary Voting System Guidelines. There will be a public EAC meeting in Washington on September 27.

The EAC draft is based on input that the National Institute of Science & Technology received from the Institute of Electrical & Electronics Engineers. The Guidelines adopted by the EAC will play a fundamental role in determining what is bought and how elections are conducted. The current draft, in my view, is deeply flawed.

I am a member of the IEEE P1583 standards committee, whose charter is "to develop an evaluation standard for election voting equipment. The standard will provide technical specifications for electronic, mechanical, and human factors that can be used by manufacturers of voting machines or by those purchasing such machines. The tests and criteria developed will assure equipment:

Accessibility

Accuracy

Confidentiality

Reliability

Security

Usability"

I am also a senior member of the IEEE, a Professor of Software Engineering at the Florida Institute of Technology, Director of Florida Tech's Center for Software Testing Education & Research. I have written three books on software testing and software quality. I am also an attorney whose focus is computer-related law.

The IEEE committee is led primarily by the voting equipment vendors and vendors to them. The meetings have been adversarial were run in a way that I consider unprofessional. For example, meeting agendas were often not posted until just before the meeting. Meeting minutes were kept uninformative--a minute might state the start and end times, the attendees, and report that the committee approved the last meeting's minutes. Other agreements or discussion from the meeting were kept off the record. There were frequent disputes over what changes the committee and its leadership had agreed to make, and who was to make them. There were inconsistencies in application of the membership and voting rules that (in my perception) always favored the agenda of the committee leadership (i.e. the voting equipment vendors) and some election administration officials whose comments in one meeting sounded to me like open contempt for voters.

The IEEE draft standard has not been voted on or approved by the IEEE. A previous draft was voted down. The current draft is highly controversial--but it was sent to government officials (see this for example)and EAC as the work in progress by IEEE, and the EAC draft looks much like it. Now that the draft was submitted to EAC, the IEEE committee has stopped meeting. One could interpret this as reflecting an underlying objective --- create a document that expresses the vendor's proposal but market it with the gloss of an independent professional society. That objective, if that is the objective, has been achieved. If that were the objective, then continued, critical formal review by the professional society would probably detract from the result achieved so far.

You don't have any input to the IEEE, but you can send comments to the EAC.

Here are some suggestions for comments:

(1) It is insufficient to limt testing of voting equipment so that it is only done by its vendor, by a vendor-paid "independent" test agency, and in a limited way by state or county election officials. There have been endless reports of functional and security errors getting past these levels of testing.

Voting equipment must be made available for purchase or lease for testing by universities and other researchers. These researchers must be allowed to publish their findings without restriction.

2. Election officials and candidates need to know the risks of the equipment they use. The proprietary interest of vendors in the secrecy of testing methods and discovered problems with their equipment must be balanced against the public interest in honest elections.

(a) Known defects, reported design weaknesses, and other known risks in voting equipment must be disclosed by the equipment vendors and the independent test labs with whom the vendors contract, to all potentially affected federal, state and county election officials within a short time after they have been discovered.

(b) Advisories of known defects, reported design weaknesses and other risks must be made available in a timely manner to all candidates ihn elections in which the relevant equipment is being used.

(c) The elections officials must have, and timely advise affected candidates of, plans in place to mitigate risks associated with the defect/weakness/risk advisories.

3. There have been repeated demonstrations of errors and insecurities with equipment by experts in the field. Rather than dismissing these or treating them as political statements, we must keep in mind that all new technologies yield products that gradually improve, but that present many flaws in design and implementation. It would be foolhardy to treat the marketing claims of reliability in voting equipment as any more credible than the marketing claims that routinely overstate the trustworthiness of other new technology.

Until the affected communities, including the research communities in computer science and computer-related security, reach consensus that the state of the art and practice in electronic voting has become trustworthy, electronic voting equipment should be treated as a fallible user interface to a voting process:

(a) Until a reliable alternative is developed and proved trustworthy, all electronic voting equipment must generate an independently verifiable paper ballot. This might be an optically scanned ballot created by the voter or a machine-printed ballot created in response to data entered into an electronic voting machine by the voter.

(b) In the event of a recount, the paper ballots will be counted and this count will be treated as authoritative.

(c) If the initial ballot count was by machine (as with optically scanned ballots), the recount will be by hand or by a different class of machine.

(d) Significant differences between electronically reported counts and recounts must be investigated.

(e) In the event of discovery of several significant differences between electronically reported counts from one type of voting equipment and the recount results, that pattern of difference provides grounds for recounting other results from the same type of equipment.

This is far from an exhaustive list, but implementation of these proposals would make a significant difference in the trustworthiness of our elections.

I would, however, note that the partisan spin results because the party in power consistently tries to turn the vote fraud issue into voter fraud issue. Secure, transparent voting systems should be an obvious non-partisan issue, but few republicans are vocally calling for this, and ACVR, a republican front, actively seeks to discredit anti-blackbox considerations in order to focus on voter id, registration fraud (only by democrats), and other less worthy vote issues.

That the IEEE has allowed itself to be used in such a manner by the EAC is lamentable. It would be useful if IEEE leadership, perhaps with your urging, would disavow the final results, something might happen. Just a quick comment for both those who are calling to open up the Diebold source code and those who claim that this insider's statements don't have real "proof"

Nothing more needs to happen to "prove" the problem than to confirm one thing he said that can be independently confirmed - does the software indeed run over Microsoft Access? If it does, then it is completely unacceptable from any kind of technical standpoint. I develop programs with various tools, including MS Access. We do NOT use Access for anything that requires any kind of security. It is simply too easy to hack. I'm not talking about the kind of security holes we hear about in MS Windows from time to time, many of which are fairly difficult to exploit. MS Access simply is not secure.

So, it doesn't matter how much credibility this guy has or doesn't have. All it takes is one of the thousands of places around the country that have the software to be willing to show a copy to someone halfway technical and they can evaluate whether it uses MS Access behind the scenes.

I found out about this during the RNC held in New York from an IndyMedia website that referred me over to the Blackbox Voting website - where what I read horrified me. I then decided because of official inaction or ineffectiveness that I would give all my energy to getting people to vote absentee. After the 2004 election, it was made clear that absentee votes just don't count because they aren't counted or are not counted in a timely manner that would make any difference to an election. Absentee ballots give a paper trail and is a system that the counties are already set up to do. However, the absentee votes must be counted and a voter cannot be sure that the absentee votes will be counted.

None of the electronic voting machines are secure. They must not be used in any county in this country or we will get another stolen election.

FEMA money has been spent to secure the corruption of elections and pay off corrupt cronyism instead of saving human lives. You will find FEMA as a big source of the problem in fixing the electronic voting machine problem. Please refer to the OpEdNew article on FEMA and about where FEMA money goes and the fact that they are not a real governmental office. Put efforts into fixing this FEMA problem and you will help fix the election system in the United States.

What can we do now? We will do the same as before and that is nothing. We're too apathetic, our leaders too unaccountable, and the practice too widespread.

And sadly enough, we bought, hook, line, and sinker, this "It's time for a regime change" but in the wrong country.

Simply because Israeli spies or sympathizers in government passed along secrets to the Israelis in no way automatically makes it true of somehow more likely that a totally unrelated activity (9/11) can also be passed off on Israelis or Israeli sympathizers. Does anybody realize that if we got our votes with a system-generated ID number (and we get to keep a legally binding copy, and we thumbprint both of them) that we could:

Have them posted at the precinct listed by the ID under ballot choices and initiatives,

Check them OURSELVES, and check the totals so we can make sure the precinct turns out in a way that isn't hokey,

Go back and get our vote FIXED if it's wrong (using our copy, our voter ID and our thumbprint.

AND,

if voting more people than there are registered voters caused a recount/revote where they checked for duplicate thumbprints (twins, triplets, etc., exempt),

We probably couldn't get screwed this majorly EVER AGAIN?

I didn't read all the comments, so please forgive possible redundancy. In the early days of our republic the fastest communication was by horseback. Ballots were carried to state capitols, thence to the national capitol. Then news of the results were sent back the same way. It took weeks at best for people to know who had won the election. Now, due to pressure from network news outfits we MUST have the results instantly. Bullshit! Let's go back to paper ballots and take an extra day or two for our results. I'd much prefer a little bit of suspense than four years of wondering, plus a large number of my fellow citizens feeling cheated.

I recall from Randy Rhodes learning just after the November 04 election about some small prescents having only 250 registered voters, mostly Democratic. That same site might deliver 5 to 6 thousand votes for GWB. The problem; no recount possible as these machines maintain no records. We can know that the Cons do not want to let go of their power. Rigged elections is their way of life.

A side thought:

We have a discussion group here comprised largely of progressives. We have been exploring the sincerity of the neo-con's professing of Christianity. It was the opinion of most that the overwhelming majority of fundamentalist (average people) do, indeed bind to their faith without question. They have been told that because of their expressed convictions they will be "saved". It is as simple as that.

We found ourselves questioning those who seek to control masses through fraud and deception. So much that comes forth from them is planned deceit, diversions, smoke and mirror ploys. It is thought that some of these folks only see religion as the Opiate of the masses and messages that they can use to to keep their troops in line. We are speaking of the PNAC crew. Those who would implement their "New World Order" through a variety of frauds and deceptions. We question the sincerity of their religious utterances because everything else that they put forth is a lie. That being so, how might their professed faith be real.

One or two in our group provided yet another insight. It was that even the top cons can make it all fit; that because they are chosen and saved, they deserve everything. In their belief deeds are irrelevant. One only needs to profess to being a Born Again, Evangelical Christian. One is then free to steal everything, create wars, topple buildings, smear opponents and rig elections. All things become fair game once sworn to their faith. They can sometimes cause themselves to believe they are doing the "will of God" and that they remain "saved" because of their commitment of faith. If they somehow bring about Armageddon, they will be imediatly transferred to a special place in their heaven

Something to ponder. Anyone have any clearer thoughts on this?

Also, I attend Stetson Kennedy's 89th birthday party in Gainesville last week. Author and long-time activist, he put Woody Guthrie up at his home in St. John's county before WWII and he'd infiltrated the KKK in the late 40's in the Atlanta area only to learn the FBI office he reported to had been themselves corrupted with racist fascists who phoned the Grand Dragon to report a "spy" in their robed midst. Stetson Kennedy received almost as many death threats as his current incarnation, Morris Dees, of the Southern Poverty Law Center, has received, methinks.

I say all this because, at 50, like a guy I met at Stetson's party, Nick Price, I'm beginning to think I'm more "radical" than "liberal." This is using the old English usage, methinks. Wasn't Dickens one of the first self-proclaimed radicals, or did he merely write such beautifully powerful literature that he towered above the field of politics?

The Us-CERT cyber alert tells us that it is possible to change votes at the voting machines by telephone. It does not prove, that it has happened. What really would help for the proof, is the list of callers to the voting machines. Some calls to the machine had a function, but there should be a call that can not be accounted for in the normal procedures. It is well possible that it is not a local call.

If someone organised fraud, he problably use just a few complices in a state to keep it secret. Theoretical this could be traced.

Let's see now. It seems I once heard something about how "The Truth Shall Set Us Free."

George Walker Bush has made a really big deal about what he has so solemnly referred to as "Freedom and Democracy." So let's go on ahead and find out the truth (I mean the whole truth) about Diebold and the 2004 national election....... via a bi-partisan congressional investigation!

And then, given the results of such a bi-partisan investigation, let's find out if George Walker Bush (the fine Christian he claims to be) is willing to live with the findings of such a democratically supported search for truth.

As my mom once told me when I was just a child: Honesty is the best policy." After 60 years, I still believe my mom was right!

Personally, I don't give a good damn what happens to our country, because if the survival of the United States of America (as we now know it) is contingent upon dishonesty and duplicity by those in power, by those who run our country....... then to hell with it all! If we have to, then let's start over. Break the damn system if we have to. All I want, as a citizen of this country, is to be able to say (and, in fact, believe it in my heart) that I live in a country that I respect: one that values the truth, strives for peace and justice, and will do what is best for humanity.

And you can take that to the bank!

No one believed me when I said that the election had already been won months before the election was even held. I got hate mail from just about everyone and not a single retraction when I was proven right. Even Ann Coultier must have throught me a sick bastard, commie traitor to suggest that the election was rigged - even though her party won and not much to her surprise (err, tabulation errors, software switches for vote flipping, etc.)

Good story, really, but there's no real proof. I have absolutely no doubt that the systems are full of security holes (Bev Harris is thorough and solid and the CERT warning isn't done on a lark, it is real) but an anonymous source making allegations without ANYTHING to offer to flesh it out as real means it is, literally, heresay and nothing more.

Your bud at Diebold, your Dieb-throat, needs to do more than just chat you (or anyone else) up with stories of corruption, incompetence, or recklessness. I suggest he/she acquire a voice-activated tape recorder, or if he/she can afford it, a solid state version of same. S/he needs to go on record to a proper authority (perhaps a Congressman like Waxman or a Senator like Schumer) and seek their protection. S/he needs to try to get others in the evil society that is Diebold to provide substantiation in some way, shape, or form. Sneak out the the source code and hand it over on the sly to a Waxman or Schumer so that they can secretly have it analyzed, the claim verified, and then pounce all over Diebold after the goods are got. This person has to be prepared to put ethics and their country before their job at Diebold. If they are worth their salt they can get a job at a less corrupt place anyway - and they would be a hero in demand with TV and publishers if they actually came forward. People LIKE heros and courage.
